房屋租赁合同登记备案办理程序
为加强华乐街房屋租赁备案市场管理,实施房屋租赁登记备案制度,规范房屋租赁登记备案行为,根据《广州市房屋租赁管理规定》等法律法规规章的规定,制定本工作程序。

关于办理房屋租赁备案的资料
Documents required for House renting registration
一、合同提供原件:(用黑色水性笔填写,不能涂改)
The original of the Rental contract (Fill in with a BLACK signing pen, It can not be altered)
提供双方签订的租赁合同一份(公司方,法人需签名并盖上公司公章、合同盖骑缝章);
The original of the Rental contract signed by both parties :1PCS (The company : the legal person shall sign and affix the company's official seal, and the Rental contract shall be affixed with the paging seal)
二、房产证或不动产权证明:
The House ownership certificate or real estate certificate.
1、房产证原件及复印件(复印件必须是整本复印:即房产证打开的每一页都必须复印);
The House ownership certificate original and copy: 1SET (The copy must be the whole copy: Every page of the property certificate must be copied)
2、如产权属于共有的,需提供房产的共有证及其他产权人的产权证明原件及复印件;
If the property right belongs to the joint ownership, the original and copy of the joint ownership certificate of other property owners shall be provided
3、房产证产权书不能提供原件核对的,可提供房产证复印件和广州市房地产档案馆出具的《广州市房地产权情况表》。
If the original of the House ownership certificate fails to provide for verification,Copy of House ownership certificate and <Form of real estate rights in Guangzhou> which issued by Guangzhou real estate archives are available.
4、特殊楼宇:环市东路372号(正佳国际中心需提供:整本购房合同原件及复印件;预告登记证明原件及复印件)
Special Building: No. 372 Huanshi Dong road (Zhengjia International Center needs to provide: Original and copy of the whole purchase contract; Original and copy of noticed registration certificate )
三、出租方和承租方须提供有效证件:
The valid certificates shall be provided by lessor andlessee
<1>、自有房产的:
Personal property
1、产权人身份证原件及复印件;
ID Card of the House owner : Original and copy
2、有委托人须提供委托书原件及复印件(公证的委托书或有产权人签名并印有指模的委托文书);
Authorized client shall provide Document of Authorization : Original and copy (Notarized power of attorney or Document of authorization signed and fingerprinted by the house owner)
3、承租方身份证原件及复印件;
ID Card of thelessee : Original and copy
4、外籍人须提供护照原件及复印件(须复印护照证面页及最新签注页)。
If thelessee is Foreigner who shall provide the Passport : Original and copy
(copy with personal information page and newest visa page )
<2>、单位出租方必须提供(原件及复印件)如下(所有资料必须盖公司公章):
Enterprise property lessor shall provide documents (original and copy) as follows (All documents must be sealed with the company's official seal):
(一)三证合一的:1、营业执照;2、法人证明书;3、法人身份证
3 in 1 : 1. Business license; 2. Certificate of the legal person; 3. ID card of the legal person
(二)非三证合一的:1、营业执照;2、组织机构代码证;3、法人证明书;4、法人身份证
Not 3 in 1 : 1. Business license;2.Organization code certificate; 3. Certificate of the legal person; 4. ID card of the legal person
(三)如有委托人签合同的:1、委托书;2、委托人身份证。
Authorized client who signed on the rental contract : 1. Document of Authorization; 2. ID card of Authorized client
<3>、单位承租方必须提供(原件及复印件)如下(所有资料必须盖公司公章):

四、转租:
Sublease:
1、须提供转租人与原出租人签订的并办理租赁登记备案的租赁合同的原件及复印件。若该合同没有原出租人同意转租的条款,必须提交原出租人同意转租的书面证明;
The original and copy of the lease contract signed by the sublessee and the original lessor and registered for lease shall be provided.If the contract does not contain the terms on which the original Lessor agrees to sublease, a written proof of the original lessor's consent to sublease must be submitted;
2、原出租人的所有资料同上第三条的出租人所需资料;
Alldocuments of the original lessor is the same as that required by the lessor in Article 3;
3、转租人及承租人的所有资料同上第三条的承租人所需资料。
Alldocuments of sublessee and lessee is the same as that of lessee in Article 3.
